Service Availability

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. Maintenance windows will be announced in advance when possible.

3. Eligibility and Account Registration

Age Requirements

• You must be at least 13 years old to use Green Mails
• Users under 18 must have parental or guardian consent
• Users in the EU between 13-16 require explicit parental consent

Account Information

• You must provide accurate, current, and complete information
• You are responsible for maintaining account security
• You must notify us immediately of any unauthorized access
• One person may maintain only one free account

Limited Access Program

Green Mails operates a limited access program to maintain our environmental standards. Account creation is subject to availability and our sustainability capacity limits.

Prohibited Activities

• Malware and Security Threats: Distributing viruses, malware, or other harmful code
• Harassment: Bullying, stalking, or harassing other users
• Fraud: Impersonation, phishing, or fraudulent activities
• Resource Abuse: Excessive use that impacts service performance
• Environmental Contradiction: Promoting activities harmful to environmental sustainability

Content Standards

While we respect your privacy and don't read your emails, content must comply with applicable laws and these Terms. We may investigate suspected violations upon reports or automated detection.

7. Subscription and Billing

Billing Terms

• Subscriptions automatically renew unless cancelled
• Price changes apply to subsequent billing cycles

• Refunds are prorated for unused periods (first 30 days)

Payment Processing

Payments are processed by our secure payment partners (Stripe, PayPal). We do not store credit card information on our servers.

8. Intellectual Property

Green Mails Property

• Service design, features, and functionality are our intellectual property
• Green Mails trademarks, logos, and brand elements are protected
• Software, algorithms, and technical innovations are proprietary

User Content

• You retain ownership of your email content and attachments
• You grant us limited rights to process and store your content
• You must not upload copyrighted material without permission
• We respond to valid DMCA takedown requests

Third-Party Content

The Service may contain links to third-party websites or services. We are not responsible for third-party content or intellectual property.

9. Limitation of Liability

Service "As Is"

Green Mails is provided "as is" and "as available" without warranties of any kind, either express or implied.

Limitation of Damages

In no event shall Green Mails be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to your account
• Interruption or cessation of transmission to or from the service

Liability Cap

Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Environmental Claims

While we strive for accurate environmental impact reporting, we make no warranties about specific environmental outcomes or the accuracy of third-party environmental data.

10. Termination

Termination by You

• You may terminate your account at any time through account settings
• Cancellation takes effect at the end of your current billing period
• You may request immediate account deletion
• Download your data before termination if desired

Termination by Us

We may terminate or suspend your account if you:

• Violate these Terms of Service
• Engage in prohibited activities
• Fail to pay subscription fees
• Create security risks for other users

Effect of Termination

• Your right to use the Service immediately ceases
• We will delete your account data within 30 days
• Environmental impact data may be retained in anonymized form
• Certain provisions of these Terms survive termination

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Jurisdiction

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in San Francisco County, California.

International Users

If you are accessing the Service from outside the United States, you agree to comply with all applicable local laws and regulations.

12. Dispute Resolution

Initial Resolution

Before pursuing formal dispute resolution, please contact our legal team at legal@greenmails.com to attempt to resolve the issue directly.

Arbitration

For disputes that cannot be resolved directly, you agree to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Class Action Waiver

You agree to bring disputes only on an individual basis and waive the right to participate in class actions or representative proceedings.

Exceptions

This arbitration provision does not apply to:

• Disputes that may be brought in small claims court
• Intellectual property disputes
• Emergency injunctive relief

13. Changes to Terms

Notification Process

• Material changes will be announced 30 days in advance
• Notice will be sent to your registered email address
• Changes will be posted on our website
• Summary of key changes will be provided

Acceptance

Continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you disagree with changes, you may terminate your account.
